Traffic Violations

Traffic Violations and the New York Points System

Traffic violations can cost you, especially if they are not dealt with immediately and in the right way. Before you simply pay a fine, realize that in doing so, you may be pleading guilty to an offense that will add points to your license and may even cause your driving privileges to be suspended.

Under New York State's points system, a conviction for a traffic offense like speeding, running stop lights or stop signs, reckless driving, failing to maintain insurance or another violation will add a specific number of points to your license. Too many points over an 18 month period, and you may face a mandatory license suspension.

Accumulating points can have other costs as well. At six points, you will have to pay a yearly "driver responsibility" assessment for three years. If you accumulate more points, the amount of the assessment will go up. Accumulating points can also lead to an increase in your insurance premiums. The costs can add up quickly.

What is the Best Way to Handle Traffic Violations?

In our experience, nobody wants to take the time out of their busy lives to deal with a traffic ticket. Most people see it as an inconvenience at best. Others hope that by ignoring a traffic violation it will somehow go away. Make no mistake, failing to answer tickets or pay fines can lead to a lengthy license suspension, car impound fees and even potential jail time.

We believe the best, most practical approach to dealing with traffic violations is to address them head-on and to fight every point that could be added to your license. Does that mean that hiring an attorney is always the answer? Not necessarily, but it is only prudent to at least talk to an experienced traffic violation defense lawyer to learn more about your rights and the potential consequences of any violations.
