Misdemeanor Drug Possession

There Is No Such Thing as a "Minor" Drug Crime

If you or a loved one is facing misdemeanor drug possession or illegal drug paraphernalia charges, it is important to remember three things:

1) Drug or paraphernalia possession is a crime. A conviction will carry serious consequences.

2) You may have options, including having your case heard in Drug Court, that can minimize the impact on your life.

3) An experienced criminal defense attorney can answer your questions and protect your rights.

What Are the Consequences of Conviction for Drug Possession?

As common as misdemeanor drug possession charges are, many people know very little about the law and the consequences of conviction. These consequences can include jail time, fines and fees and potentially lengthy license suspension.

A conviction or guilty plea will also mean that you now have a criminal record. That may make it difficult to find a job or even a place to live in the future. If you depend on a professional license, your career may be in jeopardy.

Will My Child Be Expelled for Drug Possession?

Many schools in Upstate New York have drug intervention programs. That means that children accused of drug possession may not face immediate expulsion unless they are accused of drug possession with intent to sell or distribute.

What About Legal Drugs?

It is not just recreational drugs like marijuana and Ecstasy or street drugs like cocaine or heroin that can result in drug possession charges. Prescription drugs, while legal, are also controlled substances. That means that possession of prescription drugs like OxyContin, Vicodin or Ritalin by anyone other than the person for whom the drug is prescribed may be charged as a crime.

Is There a Medical Use Exemption to the Drug Possession Laws?

It is important to note that unlike New Jersey, New York State does not allow possession of marijuana for medical purposes. Although there have been efforts to adopt "compassionate use" rules in New York, if you are found in possession of pot in our state, you may be charged with unlawful possession or worse.
